In that case the DWI charge would be class A misdemeanor. The minimum jail term for a Prior Offender is ten (10) days in jail. You may also receive the following additional punishment:

  • Up to a year in jail
  • A fine of up to one thousand dollars ($1,000.00)
  • A license suspension of one (1) to five (5) years
  • An ignition interlock device (IID) requirement for a hardship license or
  • license reinstatement
  • SATOP/VIP

You may also be forced to deal with higher insurance rates, loss of professional license, loss of employment, embarrassment. There are often errors committed by those who administer roadside sobriety tests and equipment used for breath tests if often unreliable due to operator error or failure to maintain the equipment in good condition.
